StatsCastr Terms of Use

These terms are an agreement between you and Eighty Five Creative ("we", "us") for your use of StatsCastr at statscastr.co and in our iPhone app. By creating an account or using StatsCastr, you agree to them.

Your account

  • You must be at least 13 years old to create an account.
  • Keep your sign-in details private. You're responsible for what happens under your account.
  • Give us accurate information, and keep your email address current so you can recover your account.

Your content

  • You own the teams, rosters, stats, logos and other content you add ("your content").
  • You give us permission to store, process and display your content only to run StatsCastr for you: for example to calculate stats, show box scores, show shared game pages to people you share them with, and send stats to ScoreCastr when you link a game.
  • Only add content you have the right to share. That includes players' names and information. If players are minors, make sure you have permission from your school, club or the players' parents or guardians.
  • Don't upload logos or images you don't have permission to use.

Acceptable use

Don't:

  • Break the law, or use StatsCastr to harass, threaten or harm anyone.
  • Upload anything that is illegal, offensive or infringes someone else's rights.
  • Try to get into other people's accounts or data, or interfere with or overload the service.
  • Copy, resell or reverse engineer StatsCastr, except as the law allows.

We may suspend or close accounts that break these rules.

Linking to ScoreCastr

If you link a StatsCastr game to a ScoreCastr broadcast, you're asking us to send that game's stats, team names and roster names and numbers to ScoreCastr. ScoreCastr's own terms apply to the broadcast. You can unlink at any time.

Paid features

StatsCastr is currently free. If we add paid features, we'll tell you the price and terms before you're charged.

Availability and accuracy

  • We work to keep StatsCastr running and accurate, but it is provided "as is". We don't promise it will always be available, error-free, or that stats, standings or other calculations will be correct. Check important results yourself.
  • We may change, add or remove features. If we plan to shut StatsCastr down, we'll give you notice and a way to export your stats where we reasonably can.

Ending your account

You can delete your account at any time in the app under Account → Delete account. We may close accounts that break these terms. When an account is deleted, its content is deleted as described in our Privacy Policy.

Limits on our responsibility

To the fullest extent the law allows:

  • We aren't liable for indirect, incidental, special or consequential damages, or for lost data or profits.
  • Our total liability for any claim about StatsCastr is limited to the greater of the amount you paid us in the 12 months before the claim, or US$50.

Some places don't allow these limits, so they may not apply to you.

Apple

If you use the iPhone app, these terms are between you and us, not Apple. Apple isn't responsible for the app or its support. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Your use of the app must also follow Apple's App Store terms.

Changes to these terms

If we make important changes, we'll update the date above and let you know in the app or by email. Continuing to use StatsCastr after that means you accept the new terms.

Governing law

These terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict of law rules. Any dispute about these terms or StatsCastr will be handled in the state or federal courts located in Shelby County, Tennessee, and you and we agree to those courts' jurisdiction.
